Terms & ConditionsOnline paymentsThese are terms and conditions governing the use of our Online Payment Facility provided on the Website. Please read these Terms carefully before using the Online Payment Facility. We may amend the Terms at any time by posting the amended terms on the Website. All amended Terms shall automatically become effective immediately after they are posted on the Website and any subsequent use of the Online Payment Facility shall be governed by such amended terms. By using the Online Payment Facility you agree to be bound by these Terms. Definitions "Online Payment Facility" means the online payment facility provided on the Website at http://www.tremorvah.co.uk/ ; "Privacy Policy" means our privacy policy accessible from this link "Terms" means these terms and conditions; "User" means any person using the Online Payment Facility; "Website" means the website accessible at www.tremorvah.co.uk or any such other URL address as notified from time to time. Users The Online Payment Facility is available to residents from all over the world, provided that they are registered users of the Website. All transactions through the Online Payment Facility shall be processed in Pounds Sterling only. Eligibility To be able to use the Online Payment Facility on the Website, you need to hold a valid credit card/debit card (e.g. Visa, Mastercard, American Express, Switch, Delta). Payments All payments are subject to the following conditions: Your payment will take a minimum of 2 working days to reach the account to which you are making a payment (this includes time to verify your credit/debit card details with your credit/debit card supplier and for payment to be notified to the Council). We shall make reasonable efforts to ensure that requests for electronic debits and credits involving credit cards or debit cards are processed in a timely manner. However, a number of factors, several of which are outside our control, will contribute to when the funds are received. You will receive a confirmation of your payment on your screen after you make the payment. You can print this out as confirmation by selecting the text information, choosing the print option and clicking on the 'selection' radio button option. Misuse Misuse of a credit card/debit card or use without the authorisation of the legal holder of the credit card/debit card will be dealt with in the most serious manner and we reserve the right to take legal action against those committing/attempting to commit online frauds. Limit on Volume We reserve the right to impose limits on the number of transactions or amounts which may be charged on an individual credit card/debit card or by a User during any time period, and reserve the right to refuse to process payments in respect of any transactions exceeding such limits. Discretion to reject/hold payments We reserve the right to refuse to process payments in respect of Users with a prior history of questionable charges. We may at our sole discretion do such checks as we may deem fit before processing a credit card payment or bank transfer from the User for security reasons. As part of such checks we may disclose personal data to third parties for the purpose of carrying out these security checks. In the event that we are not satisfied with the creditability of the User, we will have the right to reject the payment. The User acknowledges and agrees that we will not be liable for any damages resulting from our decision not to process a payment made through our Online Payment Facility. Data Protection The data that you provide during this transaction will only be used for the following purpose: To process your payment; and Our Privacy Policy applies to the Website and data we receive from a User via the Website and/or Online Payment Facility. Indemnification By using the Online Payment Facility the User agrees to unconditionally indemnify us against any actions, proceedings, costs, claims, damages, and awards however incurred by or arising against us as a result of your use of the Online Payment Facility. Limitation of liability In no event will the Council, its suppliers, or other third parties mentioned at this site be liable for any damages whatsoever (including, without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this site, any Websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. Governing Law This site is administered by Cornwall County Council. These terms will be governed by and construed in accordance with English law, without giving effect to any principles of conflicts of laws.
